Terms & Conditions
1. Acceptance of Terms
By engaging with Gensy (“SC ROYAL BUSINESS ACCOUNTS SRL”) for website and graphic design services, the client agrees to be bound by these terms and conditions.
2. Scope of Work
Gensy (“SC ROYAL BUSINESS ACCOUNTS SRL”) agrees to provide digital creative services, including website development and graphic design, as outlined in the project proposal. Any additional work or changes outside the initial project description requested during the development stage may incur extra costs. These additional costs will be charged at the hourly rate specified in the contract. Gensy will communicate these extra costs to the client and obtain approval before proceeding with such changes.
3. Payment Terms
Clients agree to the payment terms outlined in the contract. A non-refundable deposit, as specified in the contract, is required before the commencement of work. The remaining balance is due upon completion of the project. Late payments beyond the agreed-upon timeline may incur additional fees, as outlined in the contract.
4. Intellectual Property
Upon full payment, the client owns the intellectual property rights to the final design. Gensy (“SC ROYAL BUSINESS ACCOUNTS SRL”) retains the right to use the work for promotional purposes unless otherwise agreed upon.
5. Revisions and Changes
The client is entitled to a reasonable number of revisions during the design process as outlined in the project proposal. Any changes requested during the development stage or outside the initial project description that go beyond the agreed-upon scope of work may incur extra costs. These additional costs will be charged at the hourly rate specified in the contract. Gensy will communicate these extra costs to the client and obtain approval before proceeding with such changes. Delays in providing feedback or approvals for revisions may impact project timelines.
6. Confidentiality
Both parties agree to keep confidential any proprietary or sensitive information disclosed during the course of the project.
7. Termination of Services
Either party may terminate the project with written notice if the other party breaches these terms. Termination may result in additional fees for work completed.
8. Force Majeure
Gensy (“SC ROYAL BUSINESS ACCOUNTS SRL”) is not liable for any delay or failure in performance due to circumstances beyond its control, such as acts of nature or government actions.
9. Limitation of Liability
Gensy (“SC ROYAL BUSINESS ACCOUNTS SRL”) is not liable for any indirect, special, or consequential damages. The total liability for any claim arising out of or relating to the services shall not exceed the total amount paid by the client.
10. Dispute Resolution
In the event of any disputes arising between the client and Gensy (“SC ROYAL BUSINESS ACCOUNTS SRL”), both parties agree to engage in good-faith negotiations to seek an amicable resolution. If a resolution cannot be achieved through negotiation, the parties agree to explore alternative dispute resolution methods, such as mediation or other mutually agreed-upon approaches. Legal action will only be pursued if these methods prove unsuccessful.
By engaging with Gensy (“SC ROYAL BUSINESS ACCOUNTS SRL”), the client acknowledges and agrees to these terms and conditions.
